ACSS HOLDS MEET AND CONFER
OVER CLOSURE OF THREE CDCR/DJJ FACILITIES

ACSS met with CDCR and DPA on Friday, April 11, 2008, to discuss the impact the closure of DeWitt Nelson Youth Correctional Facility, El Paso de Robles Youth Correctional Facility and the Correctional Training Center Annex will have on our members.
DPA gave an overview of what has occurred to date:

Preliminary seniority scores have been posted.

The appeal process is underway for anyone challenging their seniority scores.
If an employee has military service or has had a break in service, be sure to carefully check your scores.

All employees have been placed on the SROA list (State Restriction of Appointments).

CDCR plans to go to each of the three facilities and meet individually with each employee to discuss their personal options, based on their seniority scores.

CDCR has contacted the Department of Mental health and Caltrans to notify them of folks on the SROA lists who can fill their vacancies.

DPA made it very clear that any current vacancies were being filled with limited-term appointments only.

DPA explained that positions covered by the Plata, Coleman and Perez lawsuits are exempt from being bumped during these layoffs, but that they would be interviewing employees on the SROA list to fill any vacancies that would be an appropriate match.

That the Training Annex will be converted into an adult re-entry facility.
ACSS made the following requests of the CDCR and DPA:

That employees who transfer to positions lower in salary have their current salaries red circled.

That employees have a “right of return” to the facility if it is “re-purposed” into an adult facility.

That the department offer a golden handshake to those employees being laid off (We were told this would not be an option, but we had to ask!)

That the department not utilize the DPA rule that provides for reduced seniority scores for employees who receive less than satisfactory annual evaluations. DPA said they would grant this request.

That CDCR provide moving and relocation expenses for employees who will be relocating as a result of being laid off.

That CDCR provide vanpool transportation for employees relocating.

Allow supervisors, managers and confidential employees to run out their accrued time (vacation, annual leave, compensation time off, personal leave plan, etc.) beyond the closure date.
