ACSS-sponsored Assembly Bill 747, authored by Assemblyman Sam Blakeslee (R-San Luis Obispo), was signed by the governor and became law on Oct. 5, 2005. It had previously sailed through both houses of the Legislature and was forwarded to Gov. Schwarzenegger on Sept. 1. The law now allows excluded employees, for catastrophic leave purposes, to receive leave credits (vacation, CTO, holiday or annual leave) from rank and file employees.
Previously, the law permitted state excluded employees to transfer annual leave, vacation, compensating time off and holiday leave credits to an excluded employee or rank and file worker who had exhausted all his or her paid time off by catastrophic illness or injury, but it did not allow the excluded employee to receive these leave credits from a rank and file worker. AB 747 corrects this discriminatory restriction.
