Partly in response to a demand letter from ACSS, the State Compensation Insurance Fund board of directors has taken a stand on the furloughs that is very beneficial to ACSS members. Specifically, the board on July 31 authorized the SCIF president and CEO, Jan Frank, to “file a cross complaint in any of the pending court proceedings to obtain a ruling from the courts that all State Fund employees are exempted from the Governor’s Furlough Order – including those employees who are not represented by unions with current cases pending)” (italics in original).
CASE (California Attorneys, Administrative Law Judges and Hearing Officers in State Employment), SEIU (Service Employees International Union) Local 1000, and CAPS (California Association of Professional Scientists) all have or had “pending court proceedings” against the governor’s furlough plan. CASE won its suit to exempt its members from the furloughs. SEIU and CAPS filed suits to extend that ruling to their members.
On behalf of ACSS, President Arlene Espinoza then wrote a letter to every member of the SCIF board demanding that results of the CASE ruling also be extended to ACSS members. On July 29, SCIF Labor Relations Officer Jean Rowan called President Espinoza to discuss ACSS’ letter. President Espinoza reiterated that we wanted the ruling to apply across the board to all SCIF employees.
In a letter dated Aug. 3, SCIF President and CEO Frank stated that the board’s direction is “appropriate regarding the Governor’s Executive furlough Order.” With the board’s support and authority, Frank wrote, “we will pursue legal action immediately.”
ACSS will continue to monitor this case and keep you informed as we learn more.
